Who are the "Paint Pen People"?

My name is Art Mallet and I am from Mechanicville NY. I have been in business since 1971, and selling on line since 1996. The company I own for doing commercial liquidation is Upstate Specialty Manufacturing, started in the late 1990s with a DBA filed in Saratoga County Clerk's office in NY in 2008. This site is a branch of that company. I started selling off a manufacturer's overstock of empty paint pens in 2006 and that got me into the paint pen business on the sales side.

The sales went well and in 2012 I started the Paint Pen People website. Since then I have sold over 350,000 paint pens and markers. I very firmly believe that if a business focuses on doing a great job of satisfying customers, and meeting their needs and expectations, the profits will follow. The buyer as part of their purchase releases Paintpenpeople.com, its owners, employees, partners, suppliers, sub-contractors and any other associated parties from any and all liability related in any way to the purchase, storage, filling, sale, loan, disposal, or any other use of this product.  The term buyer for the purpose of the seller's protection from liability or claim shall extend to the buyer, his customers, employees, sub-contractors, relatives, and anyone to whom the buyer sells, gives, lends, or otherwise transfers this product. Said waiver of liability by the seller shall also apply to completed products or services performed by but not exclusive to the buyer as defined above.

General terms of sale

Within the constraints of these conditions, I truly want satisfied repeat customers, and having been in business in one form or another since 1971, I know what it takes to accomplish that. The sheer volume of sales that I have racked up is an indicator that I run an honest, customer-centric business.

TERMS AND CONDITIONS: Every effort is made to ship your order up to 250 pieces within 2 business days; orders between 251 and 500 pieces within 3 business days, and orders over 1000 pieces within 5 business days We use first Class Mail for orders up to 25 pieces, Priority Mail for orders up to 250 pieces, UPS for orders of 500, 1000 and 2480 pieces, and an LTL freight carrier for any order over 2500 pieces.

Return Policy: All sales are final. There is no return or exchange policy for these items.  Any defective or missing parts will be replaced at no charge immediately, with shipping at my expense.

Overseas shipping: None on orders under 500 pieces. For overseas quotes on larger orders please email me. All overseas payments, other than from Commonwealth nations, must be made by T/T (bank transfer). All payments over $1000, regardless of origin, must be T/T. Shipping terms are EXW, with buyer absorbing all loss due to shipping delay, damage, or non-arrival. The buyer may elect to transfer that risk by paying for insurance either via the carrier or a 3rd party of the buyer's choice.

Insurance is available at buyer expense; seller responsibility ends with proof of receipt of goods by carrier. Please contact me if there is a problem with the count in your order, if there is shipping damage, or if the order does not arrive within 10 days. Such problems will be resolved immediately, with my apologies. I want you happy with your purchase, and will take any reasonable steps to make sure you are.
